Serena is a global platform offering mindfulness and well-being guidance. The service provides AI-generated guided meditations, breathing exercises, and mindfulness techniques through a chatbot integrated with WhatsApp. Our goal is to help users manage daily stress, improve focus, and enhance overall well-being. The platform is available 24 hours a day, 7 days a week.


2. User Responsibility


The user is responsible for interacting appropriately with the platform and using the guidance provided in a responsible manner. The use of Serena is not a substitute for professional medical advice, diagnosis, or treatment. Serena is not liable for damages resulting from misuse of the platform or from a user’s decision to disregard professional medical advice.


3. Platform Limitations


3.1. Content Scope: The platform provides guidance focused on general mindfulness and well-being. It does not offer medical advice, diagnosis, or treatment for any health condition.

3.2. Not a Medical Service: Serena should not be used as a substitute for professional healthcare. In case of a medical or mental health emergency, or if you have concerns about your health, you must seek immediate assistance from a qualified healthcare provider or contact local emergency services.

3.3. Availability: While Serena is designed for 24/7 availability, technical interruptions or service outages may occur due to maintenance or unforeseen circumstances.


4. Target Audience and Exclusions


Serena is designed for users seeking general wellness and mindfulness guidance. The platform is not intended for use by individuals with diagnosed mental health conditions or in need of clinical support. We strongly recommend that such users seek guidance from a qualified doctor or mental health professional. This service is not a crisis support line.


5. Global Registration and Usage


5.1. Registration: To use the paid services, users must register with a valid phone number and provide true and accurate information.

5.2. Account Protection: The user is responsible for maintaining the confidentiality of their account and is fully responsible for all activities that occur under their account. The user must notify Serena immediately of any unauthorized use.

5.3. Accuracy of Information: The user agrees to provide truthful information. Providing false data may result in the termination of the service.


6. Prices, Billing Model, and Payment


6.1. Prices: Serena services are based on a subscription model. Price details are specified on our website and within the platform. Prices may vary by region and are inclusive of applicable taxes.

6.2. Payment Method: Serena utilizes global payment providers. The user is responsible for ensuring all payment information is current and correct.

6.3. Self-Payment: Serena operates exclusively on a self-payment basis.


7. User Rights and Cancellation


7.1. Cancellation: The user can cancel their subscription at any time by sending an email to [email protected] or directly through the platform, where available.

7.2. Refund Policy:

7.2.1. Right of Withdrawal: In accordance with section 8, the user may be entitled to a full or proportional refund of payments made.

7.2.2. Other Cases: Outside the statutory withdrawal period, purchased subscriptions are non-refundable, except in exceptional circumstances at the sole discretion of the Serena team.


8. Right of Withdrawal (For Consumers)


If the user is a consumer, they have the right to withdraw from their subscription within 14 days of the contract date without giving any reason. To exercise this right, the user must send a clear declaration to Serena via email before the 14-day period expires. In case of withdrawal:


8.1. Refund: Serena will refund all payments received for the subscription, using the same payment method as the original transaction unless otherwise agreed.

8.2. Proportional Use: If the service was used during the withdrawal period, the user is responsible for paying an amount proportional to the service provided up to the date of the withdrawal notification.


9. Data Protection and Confidentiality


9.1. Data Protection: Serena is committed to protecting users' personal information in compliance with global data protection laws, such as the GDPR in the European Union and other applicable regulations. Please see our Privacy Policy for more details.

9.2. Data Ownership: Data generated by the user during interactions belongs to the user. Serena uses anonymized and aggregated data to improve the services, always respecting user privacy.

9.3. Confidentiality: Information shared during interactions will be kept confidential, except where disclosure is required by law.


10. Intellectual Property Rights


All content, technology, software, and branding related to Serena are the exclusive property of Serena and its licensors and are protected by copyright and other intellectual property laws. Use of the platform does not grant the user any ownership rights to its content or technology.


11. Prohibitions on Misuse


The user agrees not to:


- Use the service for any illegal purposes.

- Share, disclose, or resell Serena content.

- Use the service to collect data from other users.

- Use automated tools (e.g., bots, scrapers) to access the system.


12. Limitation of Liability and Disclaimer of Warranties


12.1. Serena is not responsible for any direct or indirect damages arising from the use or inability to use the platform, including any reliance on the information provided or any expectation of specific health or wellness outcomes.

12.2. The service is provided "as is" and "as available." Serena makes no warranty that the service will meet all individual requirements or that the guidance provided will be accurate, complete, or adequate for every individual case.


13. Global Availability and Maintenance


Serena aims for high global availability but may be subject to scheduled maintenance or downtime. Availability may vary in certain countries due to local regulations or restrictions.


14. Changes to the Terms and Conditions


Serena reserves the right to modify these Terms and Conditions. Changes will be communicated to users via email or within the platform with reasonable advance notice. Continued use of the service after such changes take effect will constitute acceptance of the new terms.


15. Jurisdiction and Applicable Law


These Terms shall be governed by the laws of the user's country of residence. Any disputes arising from these terms will be resolved in the competent courts of the user’s place of residence, ensuring compliance with local consumer protection laws.
